Rust-Oleum Corporation (founded 1921 by sea captain Robert Fergusson to formulate a rust-preventive coating for ship hulls; headquartered in Vernon Hills IL; today a subsidiary of RPM International Inc.) is one of the principal U.S. producers of industrial maintenance coatings, rust-preventive paints, and consumer paint products. Through the asbestos era, plaintiffs alleged that Rust-Oleum’s industrial coatings line — particularly heavy-duty rust-preventive paints, mastics, undercoatings, and industrial maintenance topcoats sold to shipyards, refineries, and industrial plants — was formulated with asbestos-containing fillers, extenders, or reinforcing fibers as functional additives typical of the mid-20th-century industrial-coatings market.
