Mesothelioma compensation is not a single payout from a single source. It comes from three main channels, and a person’s exposure history frequently reaches more than one of them at the same time.
1. Asbestos Trust Funds
When the major asbestos manufacturers were overwhelmed by lawsuits, many filed for bankruptcy and were required to set up trust funds to pay current and future victims. There are dozens of these trusts holding more than $30 billion combined.
- Trust claims can usually be filed without going to court.
- A single exposure history often qualifies for multiple trusts (different products from different bankrupt companies).
- Each trust has its own filing requirements and payment schedule.
See the asbestos trust funds guide.
2. Civil Lawsuits & Settlements
Not every responsible company went bankrupt. Claims against still-solvent companies — product manufacturers or premises owners whose asbestos caused the exposure — are pursued through civil litigation. The large majority of these cases are resolved through settlements rather than trials.
3. VA Benefits (for Veterans)
Veterans exposed to asbestos during military service — very commonly in the Navy — may qualify for VA disability compensation for mesothelioma and other asbestos diseases. VA benefits are separate from civil and trust claims and do not reduce them; a veteran can pursue all three.
Why These Are Pursued Together
Because asbestos was everywhere in industrial and military life, a worker or veteran was usually exposed to many different products made by many different companies — some now bankrupt (trusts), some still solvent (lawsuits). A thorough claim identifies all of these sources. This is the investigative work an experienced asbestos attorney performs: reconstructing a person’s work and life history and matching it to specific products, companies, and trusts.
Who Can Seek Compensation
- The person diagnosed with mesothelioma or another asbestos-related disease
- Family members exposed through take-home fibers or contaminated talc
- Surviving family members of someone who died of an asbestos-related disease (through wrongful-death and survival claims)
If you or a family member was diagnosed with mesothelioma or another asbestos-related disease and were exposed to asbestos, you may be entitled to compensation through asbestos trust funds and civil litigation.
